These Terms and Conditions ("Terms") govern your access to and use of bullmarketcreative.com (the "Site") and the video production and digital marketing services provided by Bull Market Advertising, L.L.C. ("Company," "we," "us," or "our"). By accessing the Site or engaging our services, you ("Client" or "you") agree to be bound by these Terms. If you do not agree, do not use the Site or our services.
For services beyond general website use, a separate proposal, statement of work, or service agreement between you and Bull Market Creative takes precedence over these Terms.
1. Services
Bull Market Advertising, L.L.C. provides video production and marketing services, which may include but are not limited to: brand videos, interviews, testimonials, social media content, Meta ad management, and related creative and marketing work ("Services"). The specific scope, deliverables, timeline, and fees for any engagement will be outlined in a separate proposal, invoice, or service agreement ("Agreement").
In the event of a conflict between these Terms and a signed Agreement, the Agreement controls with respect to that engagement.
2. Use of the Site
You agree to use the Site only for lawful purposes. You may not:
- Use the Site in any way that violates applicable law or regulation
- Attempt to gain unauthorized access to any portion of the Site or its related systems
- Use automated means (bots, scrapers) to access the Site without our prior written consent
- Interfere with the proper functioning of the Site
We reserve the right to restrict or terminate your access to the Site at our discretion.
3. Limitation of Liability
To the maximum extent permitted by law, Bull Market Advertising, L.L.C. and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from or related to your use of the Site.
4. Indemnification
You agree to indemnify and hold harmless Bull Market Advertising, L.L.C., its owners, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of: (a) your breach of these Terms; (b) your use of the Site or Services; (c) materials you provide to us; or (d) your violation of applicable law or third-party rights.
5. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of such courts.
6. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of the Site or Services after changes are posted constitutes acceptance of the updated Terms.
